Amanda Davis found not guilty of DUI

After being charged with DUI and reckless driving in November, 2012, former Fox 5 anchor Amanda Davis was cleared of those charges Friday in Fulton County court today.

Channel 2 Action News was there.

On November 11, 2012, Davis was allegedly driving southbound in the northbound lane and her vehicle crashed into another vehicle, injuring that driver. She was arrested and charged with DUI, reckless driving and failure to maintain lane.

Today, she was found guilty only of failure to maintain lane. She was fined $200 and told to do 20 hours of community service.

Davis, who was at WAGA-TV for 26 years, was taken off the air and retired the following April. The retirement was not voluntary. She has not commented about her situation since it happened. (I last wrote about the case in November here.)

Her attorney William Head has not returned a call and email seeking comment. Head said she is not planning to release a statement and he himself declined to comment as well.

George Stein, an attorney in town who specializes in DUIs, is not familiar with the details of this particular case but said in situations where the primary charges are dropped and only a moving violation remains, the defendant typically is fined and sometimes given community service. That is exactly what happened to Davis.

In Stein’s mind, given the circumstances, Fox 5 “should really reconsider and take a look at rehiring her. She is an experienced, talented broadcaster.” (Fox 5 has since hired Cynne Simpson to replace Davis.) A Fox spokeswoman had no comment but the network did post the news on its website.

Former Fox 5 reporter Brett Martin said he doubts Fox 5 would take her back but thinks CBS Atlanta might be interested, given her brand equity in the market. “I hope she is on the road of sobriety and takes it one day at a time. She has made some mistakes in her life dealing with substance abuse. She needs to address that.” Also, he wonders if Fox 5 was right in letting her go in the first place, he noted.

David Jarman, the man whose vehicle she hit, filed a civil lawsuit against her last June seeking compensation for medical costs related to injuries he suffered from the accident. The attorneys representing his case have not yet returned calls to discuss how the criminal case will affect their lawsuit.

Everyone needs to remember that "Not Guilty" does not mean she wasn't driving drunk. The defense placed enough doubt that she couldn't be convicted. That's all. That's what defense lawyers are paid to do.


I don't know her and I wasn't there. She has done alot of good in the community. I just hope the person she ran into is taken care of and not forgotten in this situation. No matter whether she is guilty or not, they are still out of a vehicle and is still shaken up from the ordeal I bet. The person is the real victim in all of this...

addendum- you cannot be falling down drunk (stumbling and slurring speech) either because they video and it can be used to convict.  Say nothing stand still and respectfully decline to take any tests - go to jail quietly and call lawyer - apparently Amanda's would be good

no jury - no evidence because she refused to blow - crosses center after midnight and almost injures someone - not guilty - on other hand, someone I know gets stopped in Athens - no wreck - no speeding - a block from home - thinks is sober but fails blow - DUI - pleads guilty and it has ruined him for years - the only conviction he has ever had. it has affected job opportunities, insurance rates etc. AND it never comes off record.


What's wrong with this picture? - lesson learned - never EVER blow if you have been drinking at all - as long as you are not poor you will beat the rap

I don't drive drunk, have never been arrested for even a suspicion of driving under the influence, have never been arrested ever, period.

With all that said, Fox jumped the gun on parting ways with Davis. You'd think that after 26 years with the station and good works (like Tuesday's Child) it would build a little goodwill for her. Yes, she made a mistake. She had been drinking and she admitted it. She should not have been out there. 


But really? Do you take away someone's millstone for making a mistake, particularly a mistake that millions make every year? 


We act like intoxicated drivers are Satan-in-the-flesh. It was a mistake. And don't give me that crap about how this wasn't her first time. It was her first time in 25 years.


You people act like one mistake is all we get in life. Over 25 years of not an incident but, HEY!, she messed up AGAIN!!!


I hope all of you receive the same mercy you accord others when your time comes.

She was arrested for DUI in south Dekalb about 25 years ago, but that time she had a small child in the car. 

Isn't she alittle old not to have learned her lesson yet?

I hope she finally goes away.

So the lesson learned here is, if your rich or famous or a local tv or radio personality you can get away with driving drunk ( again) on the wrong side of the road and just pay the fine.

Sooner or later she'll kill someone but it won't be her fault

I am sorry I have No PITY for this woman. Only by the grace of God did she Not KILL some innocent Driver or herself in this unfortunate incident. Ms. Davis knows and understands her illness. There is Absolutely No excuse, for her getting behind the wheel in such a State of Mind. 

This is NOT the First Time for her at this RODEO. Let us all hope and pray that she maintains a presence of mind NOT to have a repeat this offense. However, I am not that encouraged about it.

The NEXT Time may not be as forgiving and with far more reaching impact on other innocent Lives.

Maybe any one of Your, Family, and/or friends Lives unnecessarily.

Also who can forget Affluenza were that rich TX daddy bought some good justice for his child. The teenager killed 4 people and maimed one and is in rehab. I would say her getting a fine and community service is more than that MF!!

Wow wondered what happened on this subject. No surprise she was retired against her will-spin most likely. This was just a good reason for the powers that be to put her off air. Also she can't make an issue of it because she was in the media and if she wants to stand a chance at obtaining another job she has to be quiet.

I agree with Susan89.  We don't live in a perfect world.  Chances of Fox-5 wanting her back would appear very unlikely... and I could picture CBS Atlanta (WGCL-TV) showing interest in hiring her, possibly as a fill-in anchor and reporter, unless CBS is mulling over reviving weekday Noon newscast.  Amanda showing up on CBS Atlanta wouldn't happen right away, if she may have to wait until the non-compete clause (usually runs 6-12 months on average) in her Fox contract to expire.

Just goes to show, you get the justice you pay for.  Apparently, Amanda Davis had a lot of money stashed away for such an occasion (call it her rainy DUI fund).  Personally, I will 100% boycott any organization that chooses to hire her.  She is spoiled goods.

I was charged with DUI because I pissed off the cop. When the judge heard the case he threw it out of court and let the cop have it.

I think Mrs. Davis was DUI but if the cop didn't do it properly then she got off easy for sure.

It is always interesting when people say someone is gulity before a trial.

These are normally the people who have never read or chose not to read the US Constitution.since it's the law of the law Maybe they should. However we all know they won't.

I give Amanda all the credit in the world. She hired the best. However, this doesn't mean she won't be sued. The civil case has a different standard of proof (lower) and she might  very well be held liable for negligence. I hope she get some help for her alcohol issues. I don't see any reason to beat her down any more, she's disgraced as it is....

Bubba Head is the best DUI attorney in Georgia, hands down. I know attorneys who have told me when they have a question about a DUI case... they give him a call. No kidding... He is the best... period.

I would agree that we've not seen much of Ken Rodriguez (nicknamed K-Rod) lately.  His biography is still on myfoxatlanta.com.  Not sure if Rodney has heard anything different.  I don't care too much for those seen filling in for him.


I liked Karen Graham and Buck Lanford as sports anchors, before both transitioned to Good Day Atlanta... also liked former Fox-5 sports anchor Chris Clark, and not sure whatever became of him.  Bill Hartman does sideline reporting for High 5 Sports game-of-the-week.

@Laurie1113  You better start boycotting almost every company in the US. There are plenty of higher-up that have DUIs that run companies that can't be fired. Politicians have drinking and drug issues too. Without Liquor we wouldn't have the KENNEDY clan and all their corrupt crap.

@Correction @Laurie1113Who is Marv Albert? I do remember a traffic man on ch 5 that flew around in a helicopter. I wish I could remember his name but it has been so long (Tom something?). Anyway, he was at Lake Lanier drinking on his parked houseboat and his girlfriend ended up dead in the lake. He could not remember what happened. Ch 5 let him go right away.

That's why our system is an adversarial system.... different parties and their advocates face off. There is nothing stopping Fulton county from hiring Bubba to prosecute cases such as this.... although he don't come cheap!!  Prosecutors get advice from him all the time.... all attorneys do! He's a really good guy and a total pro. Were you the ACCUSED... you would see it similarly. Right?
