A local general contractor has filed a lawsuit claiming Kandi Burruss and her husband Todd Tucker have not paid him for $16,512 in work he did last year on their new restaurant Old Lady Gang.
Charles Busbee filed the lawsuit September 25 in Fulton County Superior Court.
He said he did the work between March 19 and June 27, 2016. In the lawsuit, he said Burruss and Tucker’s architect and third defendant Cedric Drayton wrote them checks totaling $16,512 but then refused to pay them. He said he was forced to pay his crew of workers out of his own pocket.
Busbee had previously filed a lawsuit trying to get his money. On September 26, 2016, the two parties appeared in court and Drayton admitted to not paying and agreed to restitution payments over a year.
To date, Busbee has not received a penny, he said in the lawsuit.
Busbee, a carpenter, is seeking his monies plus interest. For now, he is claiming a lien on the property at 185 Peters Street in Atlanta.
UPDATE: On Friday, September 29, Kandi and Todd released a statement through their attorney, saying this dispute has nothing to do with them but is really between Drayton and Busbee:
“The lawsuit filed against Kandi, Todd and their Old Lady Gang restaurant is false, attention-seeking and utterly meritless against them. Statements made in the petitioner’s complaint, as well as documents he filed and attached to it, clearly show this was a dispute between the petitioner and the other named defendant who hired him. My clients do not owe the petitioner anything, except a copy of pleadings I am filing that will include a request for damages if he does not dismiss my clients as parties to this frivolous lawsuit immediately.” Precious Anderson, Esq.
